General Terms and Conditions   NonSoloCasa GmbH ( NSC )

The rental agreement for a property between landlord and tenant includes the following contractual terms:  

1.Booking / advance payment
1.1 Upon receipt of your booking in writing you will receive by email – or upon explicit request by snail mail or telefax – our firm confirmation of your booking. The client as well as any fellow occupant(s) is liable for any obligations arising from the rental contract.
1.2 Within ten days of receipt of the booking confirmation a deposit of 30 % of the overall price is payable, to be remitted to the account stated below. Should this deposit fail to be remitted in the specified period the landlord - after a reminder with setting of a deadline - is entitled to withdraw from the contract and to claim cancellation charges according to figure 2 of this agreement if applicable.
1.3 The remainder of the money is due 30 days before starting occupancy of the property. Should the residual payment not be credited to the NonSoloCasa collection account the landlord - after a reminder with setting of a deadline - is entitled to withdraw from the contract and to claim cancellation charges according to figure 2 of this agreement from the client.
1.4 If the time between confirmation of booking and start of occupancy is less than 40 days the overall price is payable at once without any advance payment.
1.5 There is no entitlement to occupancy unless the price for the booked property has been paid in full.
1.6 Upon receipt of the residual payment we will send you the travel documents, i.e. address, description of how to get there and information about the handover of the key.
2. Client cancellation
2.1 Prior to occupancy the client is entitled to cancel the contract at any time. The cancellation shall be in writing.
2.2 In the case of cancellation compensation will be claimed:
a) Cancellation up until 60 days prior to occupancy 30% of the overall price.
b) Cancellation from 59th until 16th day prior to occupancy 50% of the overall price
c) Cancellation from 15th until 1st day prior to occupancy 80% of the overall price
2.3 Should the property booked by the client remain vacant without the client having expressly cancelled the contract then the client shall be liable to pay the overall price.
Late arrival and/or early departure do not constitute a refund claim.
2.4 The client is entitled to provide a replacement who shall assume the client’s obligations and rights in full. A handling charge of Euros 25.00 may be payable for this. There shall be no cancellation charges.

3. NSC / Landlord cancellation
The owner, represented of NSC, shall be entitled to withdraw from the contract if unforeseeable or unavoidable circumstances e.g. war or act of nature make the stay impossible, affect appreciably, aggravate or endanger. In this case the owner offers an equivalent object. The client has no further right of compensation.
NSC can cancel the contract, if the client behaves contrary to agreement. The client has no claim to get the rental charge back.

4. NonSoloCasa’s liability

4.1
In the achievements of NSC and the provider (landlord) are no insurances contained. For the own security of the customer NSC recommends a private liability insurance.
4.2 NonSoloCasa
is merely the agent between client and landlord and acts on behalf of and on account of the landlord. Therefore, NonSoloCasa shall not be liable for services to be provided to the client by the appropriate service providers. Any claims for compensation can only be asserted towards these people under Italian law. The landlord shall be liable neither for personal injury nor the possessions/valuables of the client or his fellow occupant(s).

4.3 The information on the individual properties have been made available to us by the landlords and have been carefully checked. NonSoloCasa, however, shall not be liable for any errors or omissions.

5. The client’s obligations

5.1 The booked property may only be occupied by the contractually agreed number of people.
In the case of overcrowding the landlord/NSC is entitled to lay claim to a reasonable compensation for the time of the overcrowding irrespective of the right to terminate the contract. The unannounced persons have to leave the property without delay.
5.2 The client shall be liable to the landlord for any culpable damage to the let property and/or to the equipment/furniture. The guest is obliged to take good care of the property and to indicate the landlord or NSC all damages and defects immediately during the rental period. The guest is liable for damages caused during the rental period, he has to compensate for them. If additional damage is caused due to belated notification by the guest, the guest is held responsible. In case of imminent danger the proprietor is authorized to enter the contractive property and take first countermeasures. The guest shall treat the let property with due care and shall take care of regular cleaning of the property.The final cleaning, possibly contained in the price, doesn’t include the cleaning of the dishes, the stove, the oven, the refrigerator and the kitchen appliances, which must be left in clean state. The property must be delivered clean. Potential damages due to the regulations stated above and payable by the guest must be paid to the proprietor or his proxy before departure.
5.3 Pets are only allowed at the acknowledged properties and must be indicated when booking.
6. Important hints
6.1 Arrival is between 4 p.m. and 8 p.m. A requirement on key delivery on journey day does not exist with later arrival. A delay is to be indicated by the guest in any case. The customer is obligated to transact the calls with the owner, as indicated in the description of journey, even if NSC was informed about a later arrival. Costs for overnight stay based on to late arrival or missed calling go debited to the customer. The departure must be before 10,00 a.m. at the latest.
6.2 Bedlinen and towels as well as the final cleaning are included in the overall price with most properties. Please note what the description of the property says.
6.3 With most properties the costs for heating (e.g. gas/wood) are not included in the overall price and need to be paid for locally to the landlord before departure.
6.4 With some properties there is a deposit to be paid before occupancy which is going to be refunded locally by the landlord deducting damages and/or additional costs if any. Please refer to the individual property descriptions.
